OHSAA sets text and voting dates for NIL bylaw, explained

COLUMBUS, Ohio - The Ohio High School Athletic Association Board of Directors has set the dates for voting on name, image, and likeness in the form of an emergency referendum for Ohio student-athletes.

According to the press release issued by the association, this indicates that member schools will gather, and the final decision will be communicated by the principal of the school.

Those dates for schools to cast their vote will be November 17-21. Additionally, the full text of the bylaw proposal (language) was board-approved in September for a vote of member schools during the regular referendum in early May due to legal action as permitted by OHSAA bylaw 8-1-1. 

The situation arises following a lawsuit initiated on behalf of Jamir Brown (Ohio State commit), an athlete from Wayne High School, who claims that he has lost more than $100,000 in NIL benefits. However, due to the OHSAA's prohibition against student-athletes receiving such benefits, Mr. Brown's mother sought out legal recourse through the courts. 

The courts granted a 45-day restraining order from Judge Jaiza Page of the Franklin County Court of Common Pleas in the days preceding the emergency referendum voting. 

In Mr. Brown's case, he has already used the restraining order to sign an NIL deal with Leaf Trading Card Co., as announced via his Instagram account.
