Kirk Barton's case bound over to grand jury

COLUMBUS, Ohio - Kirk Barton was scheduled to attend a preliminary hearing on July 1 in the Franklin County Court of Common Pleas regarding charges of aggravated vehicular homicide related to the crash that resulted in the death of Ethan Perry. 

His attorney, Samual H. Shamansky, represented him on his behalf to have the hearing waived and sent to the Franklin County grand jury, according to court documents. 

Barton faces allegations of operating his 2025 Ford F150 Raptor pickup truck at an excessive speed in the wrong direction on the eastbound lane of the US-33 interstate. After correcting his course, he proceeded eastbound on US-33/W. Bridge St. near the intersection of Franklin St. and W. Bridge St., where he collided with a 2012 Lexus IS 250 driven by Ethan Perry at 2:56 a.m.

Perry was pronounced dead at the scene of the accident, while Barton's vehicle was found approximately 900 feet from the original collision site. During the investigation, Dublin Police reported Barton was under the influence of alcohol, as indicated by the subsequent odor of alcohol, slurred speech, and glassy eyes, and police-worn body cam video. 

Probable Cause was based on those observations and an interview later with Dublin detectives, where he stated that he had consumed alcoholic beverages before the crash.

Currently, there is no public record of a toxicology report, nor is there information regarding the speed at which Barton was traveling. He is out on a $500,000 bond but under house arrest using the court-ordered SCRAM bracelet.
