Kirk Barton pleads not guilty to indictment charges in fatal crash

COLUMBUS, Ohio - Kirk Barton returned to court to respond to the indictment charges related to the fatal accident that resulted in the death of 24-year-old Ethan Wence Perry in June, according to ABC6.

According to court documents, Barton entered a plea of not guilty regarding the charges of aggravated vehicular homicide, which includes an additional charge of the same count, as well as operating a motor vehicle while under the influence of alcohol, a drug of abuse, or a combination of both, also two counts.

Dublin police allege he was driving under the influence when he collided with Ethan Perry's vehicle along US 33/OH 161 around 2:56 a.m. on June 21. 

His blood alcohol level was 0.17 at the time of the accident. In Ohio, the legal limit is 0.08 for adults 21 or over. According to Ohio laws, anything 0.17 or higher is considered super intoxicated and comes with harsher penalties. 

He is currently out on a $500,000 bond, but an additional $10,000 recognizance bond was applied to ensure he would return to court, according to court documents, as he is still on house arrest.

The second count of aggravated vehicular homicide was applied because he was operating a motor vehicle recklessly and caused the death of Ethan Perry, along with the second OVI count, which amended the indictment to four counts from the initial bindover. 

His attorney, Sam Shamansky, made a statement during the court hearing, "You would have to be the most stone cold hearted human being in the world not to be drowning in remorse and sorrow, whether you're at fault or not at fault, a life was lost, Mr. Barton grieves along with the rest of us," he said. 

The defendant played football for Massillon Perry and the Ohio State University.

Barton's next court date has not been scheduled, according to court documents.
